Permits

In order for any facility to install or operate a regulated air emissions unit, the Ohio Environmental Protection Agency (OEPA) requires the company to first obtain a permit. The P&E Section prepares two types of permits, Permits to Install (PTIs) and Permits to Operate (PTOs). PTIs are required for all companies wanting to install new emissions units and must be obtained through the AQMD, with final approval from the OEPA. DOES makes the Applications for PTIs available for review. Companies must apply for a PTO in order to operate emissions units. Again, the AQMD makes recommendations to the OEPA, who then issues the permit.

Title V permits are required for companies that have emissions or hazardous emissions greater than a predetermined major source threshold. With Title V, an entire facility with multiple emission units is covered under one permit. The terms and conditions of the Title V operating permit are enforced by the state and/or federal government. Title V permits also allow for a 30-day public comment period, prior to final issuance, which offers residents an opportunity to voice concerns.

Permit Program Changes/Updates

Ohio EPA has increased the number of permit-by-rule categories in the Ohio Administrative Code.  Facilities which meet the permit-by-rule qualifications are exempt from obtaining air permits as long as they meet requirements in the rule.  Operations which have been added to the permit-by-rule include the following: auto body refinishing operations, gasoline dispensing facilities, natural gas fired boilers, and small and medium sizes printing facilities.  Senate Bill 265 was passed which now exempts new air contaminant sources from complying with best available technology if the emissions are below 10 tons per year for each criteria pollutant.
