National Parks, Recreation Areas and State Parks Limits of waste placement may not be located in any of the following areas:

a. National Park or recreation area
b. Candidate area for National Park
c. State Park or park purchase area
d. Property within boundaries of National Park or recreation area
New Siting Regulations will amend ORC to prohibit limits of waste placement from being placed within 1,000' of a park.
Ground Water Aquifer Protection A. Sanitary landfill may not be located in a sand or gravel pit where the sand or gravel deposit has not been completely removed.

B. Sanitary landfill facility may not be located in a limestone quarry or sandstone quarry (UDABD).

C. The Sanitary Landfill facility may not be located above an aquifer declared by the federal government under the "Safe Drinking Water Act" to be a sole source aquifer prior to the date of receipt of the PTI.

D. Sanitary Landfill facility may not be located above an unconsolidated aquifer capable of sustaining a yield of one hundred gallons per minute for a twenty four hour period to an existing or future water supply well located within one thousand feet of the limits of waste placement (UDABD).

E. Isolation distance between the uppermost aquifer system and the bottom of the recompacted soil liner of a sanitary landfill facility may not be less than 15 feet of in-situ or added geologic material.

 
Ground Water Setbacks A. Landfill may not be located within the surface and subsurface areas surrounding a public water supply well through which contaminants may move toward and may reach the public water supply well within a period of five years.

B. Landfill may not be located within an area of potential subsidence due to an underground mine in existence on the date of receipt of PTI.

C. Limits of waste placement may not be located within 1,000 feet of a water supply well or a developed spring in existence on the date of the PTI submittal (UDABD).

ORC offers several examples of when item C of this rule may be bypassed.

(i.e. groundwater monitoring wells, needed source of non-potable water, well or spring controlled by owner of facility, etc.)

General Setbacks A. One thousand feet from natural areas

B. Three hundred feet from a property line

C. One thousand feet from a domicile.

D. Two hundred feet from surface waters

(UDABD)
